These general terms of sale apply to all commercial transactions carried out on our website www.tossadivers.com, a domain owned by TOSSA DIVERS S.L., a company legally established in Spain (NIF: B04953709).
TOSSA DIVERS S.L. reserves the right to modify the commercial offer on the website at any time (changes to products, prices, promotions and other commercial and service conditions). Such modifications will not apply to transactions already completed.
TOSSA DIVERS S.L. strives daily to offer updated, truthful information free of typographical errors. Should any such error occur, it will be corrected immediately. If a typographical error exists in any of the prices shown and a customer has made a purchase decision based on that error, TOSSA DIVERS S.L. will notify the customer of said error and the customer will have the right to cancel the purchase at no cost.
The contents of www.tossadivers.com may occasionally show provisional information about the nature of some products. Should the information provided not correspond to the product characteristics, the customer shall have the right to cancel the purchase at no cost.
TOSSA DIVERS S.L. is not directly or indirectly responsible for any information, content, statements or expressions contained in the products marketed through www.tossadivers.com. Such responsibility lies at all times with the manufacturers or distributors of said products. The customer understands that TOSSA DIVERS S.L. is a mere intermediary between them and said manufacturer or distributor.

2. Commercial communications
Your data will be incorporated into a file under the responsibility of TOSSA DIVERS S.L., for the purpose of managing the processing and execution of your order.
By accepting these conditions, you expressly authorise TOSSA DIVERS S.L. to send you informative and commercial communications related to its products and services, by electronic means such as email and WhatsApp, in accordance with Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).
You may revoke your consent to receive such communications at any time by sending an email to info@tossadivers.com or by replying with the word UNSUBSCRIBE to any of the messages received.
3. User and/or customer obligations
The user and/or customer of www.tossadivers.com undertakes at all times to provide truthful information regarding the data requested in the user registration form, and to keep it updated at all times.
In the event that the sale or marketing of products on our website requires the buyer to be of a certain age according to the legislation in force in their country of origin, the buyer declares that they meet this requirement to formalise the purchase.
Purchases are valid for 1 year from the date of purchase. After this year, TOSSA DIVERS S.L. reserves the right not to provide the service due to expiration.
4. Applicable law and competent jurisdiction
Purchases made with TOSSA DIVERS S.L. are subject to Spanish law.
These Terms of Sale are governed by Spanish law. The parties submit to the courts and tribunals of Girona for the resolution of conflicts, waiving any other jurisdiction.
In case of disagreement in the explanation, interpretation or non-compliance of this contract, the parties shall submit to the Courts and Tribunals of Girona.
5. Cancellation policy
Once customers have booked and paid for any activity with TOSSA DIVERS S.L. there is no refund policy. TOSSA DIVERS S.L. may cancel the activity even on the same day if sea conditions do not permit or make the activity dangerous and, in this case, the money will not be refunded; the customer will be offered the option to carry out the activity on another date of their choice.
If the customer with a date reservation wishes to change the date, they may do so up to 48 hours before the time/day of the activity so that TOSSA DIVERS S.L. has time to fill the places. If the customer does not show up on the set day and time or gives less than 48 hours notice of cancellation, the money will not be refunded and no date change will be accepted.
6. Shipping policy
As everything sold consists of services, we do not make shipments.
7. Purchase expiry
All products and services purchased on the TossaDivers website are valid for 1 year from the date of purchase.
TOSSA DIVERS S.L. reserves the right to make any changes it deems appropriate to the established terms and conditions. Modifications will be prominently included on www.tossadivers.com.

8. Right of withdrawal
The customer has a period of 14 days to withdraw from the purchase, counted from the time of purchase, as there is no product shipment.
To notify us of withdrawal, the customer must contact us through the contact form on the CONTACT tab of this website, stating withdrawal in the message.
The 14-day period will be cancelled and will not give rise to withdrawal in the following exceptions:
- Purchases of excursions, trips, experiences, courses or similar where a date has been confirmed. Date confirmation can be at the time of purchase, if the customer books with day and time, or also if, after the purchase, through any other means outside this website, the customer requests an appointment and the appointment is confirmed. The customer may modify the date as long as they do so more than 48 hours in advance. However, in no case will they be entitled to a refund.
- Purchases accompanied by a personalised gift voucher. The 14-day period does not apply to purchases where the customer instantly receives a personalised gift voucher, valid for use from that very moment. This also applies to customers who do not buy the gift voucher on the website but request and receive it from the company by any other means.
- For courses purchased on this website, the 14-day period will not apply and will be void with no right to refund in cases where the customer has received the online theory of the course and has registered for it. It will also not apply if the customer, at the time of purchase or at any other time and by any means, requests a confirmed reservation date from the company and this is confirmed by the company.
No refund will be made in cases where the participant does not meet the medical or legal requirements for carrying out the activity, decides to abandon the course once started of their own volition, or does not obtain the corresponding certification by not satisfactorily completing the training.
